Antiques Sales Policy

Payment

  • All items must be paid in full at time of purchase. Checks, wire transfers, Visa, Mastercard, and American Express are accepted
  • Sales tax is not charged on items shipped outside of Minnesota. However, we are required to charge a 7.15% tax on all retail sales in the state of Minnesota, which will automatically be calculated and added to your total order at the time of purchase

Returns

  • If you are unsatisfied with your antique, you may return it to Three Pagodas in its original condition within 7 days of purchase for a full refund or within 14 days of purchase for a full store credit. A receipt must accompany all returns, as well as a credit card for any refunds
  • ALL SALE AND DISCOUNT ITEMS ARE FINAL and are not subject to return

Storage

  • If you are unable to accept delivery of your antiques within 60 days of purchase, your merchandise may be stored at Three Pagodas warehouse at your own risk and expense. After 60 days from the date of purchase, a fee of $5.00 per item per day will be billed to you. All storage expenses must be paid in full before release of your antiques from Three Pagodas warehouse

Additional Terms

  • Three Pagodas is not liable for any damage that occurs to any antique once it leaves Three Pagodas warehouse. While Three Pagodas can assist you with any repairs, the customer assumes all responsibility for any expenses incurred. For information on how to properly care for your antiques, please see the Cleaning and Care section of our site at www.threepagodas.net
  • There is no warranty on any antique purchased from Three Pagodas. All of our antiques are sold on an as-is basis and there is no expressed or implied warranty therein
  • Any restoration or alteration you request to have completed on any antique your purchase from Three Pagodas is non-refundable

Terms

INITIAL DEVELOPMENT OF PIECE

Three Pagodas takes great pride in being able to assist our customers in creating products specially crafted to meet their specific design needs. For this reason we offer free consultation to help each customer identify the type of piece desired, how the creation will work in a given space, and fully explore the range of materials, finishes, and hardware

AutoCAD DRAWING

Once the details of a piece have been selected, Three Pagodas will provide an AutoCAD or color-rendered drawing of the piece. A $250 up-front, non-refundable drawing fee is required. This fee covers the initial AutoCAD drawing, plus two additional changes to the drawing. Each subsequent change may incur an additional $150 charge depending on the complexity of the request. The customer will own any and all drawings produced. If we build the piece, the initial drawing fee will be applied to the final purchase price.

PRICE QUOTE FOR CONSTRUCTION/ESTIMATED DELIVERY DATE

Within one week of the customer? approval of the Auto-CAD drawing, Three Pagodas will provide a quote for the piece which is good for 30 days. In addition, a conditional estimated delivery date will be provided which is good for 14 days.

The quoted price includes all materials, construction, and finishing. Please note that local delivery charges (i.e. delivery from Three Pagodas to the piece? final destination) and any applicable taxes are not included in this estimate.

The estimated delivery date is an approximation of production and shipment time. Three Pagodas is not responsible for delays resulting from circumstances beyond its control such as unforeseen complications with materials, schedules of subcontractors, design limitations, strike or other labor disputes, fires, civil disturbances, wars, or other acts of God. Should such a delay occur, Three Pagodas will notify the customer immediately.

NON-REFUNDABLE DOWN PAYMENT

Three Pagodas requires a non-refundable down payment of 50% of the cost of the piece at the time the Custom Order Agreement is signed. As production usually begins immediately thereafter, NO CHANGES MAY BE MADE ONCE THE CUSTOMER SIGNS THE CUSTOM ORDER AGREEMENT.

PRODUCTION PHASE

Once production begins, no changes may be made to the product or its design. However, because the piece is one-of-a-kind, our carpenters may have concerns about the product? design or its aesthetic elements that were not apparent in the pre-production stage. In such an instance, Three Pagodas will discuss these considerations with the customer, and, should the customer agree, the changes will be implemented into the final piece. Any changes must be approved by the customer in writing. Upon completion, our Chinese carpenters will forward a photo of the piece to Three Pagodas.

RETURNS

All sales are final. However, if the customer is not completely satisfied with the piece, we will do our utmost to help resolve the problem. Any modifications made to the piece not reflected in the customer-approved AutoCAD drawing will be billed to the customer. Please also note that many of the materials used to construct the piece are created from scratch and, particularly in the case of lacquers and stains, may vary somewhat from Three Pagodas samples. Three Pagodas is not responsible for such variations.

Three Pagodas will offer a full replacement if the piece does not match the customer-approved AutoCAD drawing.

PRODUCT LIABILITY

While Three Pagodas will make every effort to resolve problems that may occur after the piece has left our warehouse, we cannot assume any liability for potential problems that may occur outside our warehouse. All pieces are custom made to order and are customer designed. For this reason, Three Pagodas disclaims all warranties, express and implied, including implied warrantees of merchantability and of fitness for a particular purpose. Three Pagodas is not liable for changes that may occur to the piece including but not limited to changes relating to wear and tear, expansion and contraction of wood and joinery, limitations of the finish or other materials chosen, limitations of the design developed by the customer or designer, etc. nor is Three Pagodas liable for any injury, harm, or death that might occur due to the use of the piece.

COUPONS AND DISCOUNTS

Coupons and discounts do not apply to Three Pagodas custom-built furniture unless previously discussed. Any discounts and/or coupons used for the purchase of our custom furniture must be discussed before a purchase agreement or any related documents are signed. Any coupons and discounts will be reflected in writing on the client? invoice.

Delivery Policy

Whether you live locally, out-of-state, or abroad, Three Pagodas will help to arrange delivery of your purchase with one of our preferred carriers. Unless notified in writing, the customer assumes all packing, crating, insurance, and delivery charges as well as all risk. All related costs will be quoted upon request and are determined by size, weight, value, and location of your delivery. Please make sure to inform us of any special delivery issues (i.e. stairs, elevators, limited access to delivery location, etc.) that may affect your shipping costs. Three Pagodas will provide you with an estimated delivery date and with all the necessary information to track and coordinate the delivery of your shipment. The following terms and conditions apply:

PAYMENT

  • Delivery must be prepaid, C.O.D., or third party collection. All related costs will be added to the balance of your purchase and, if prepaying, are due in full prior to shipping
  • Delivery charges are non-refundable
  • Delivery charges are not subject to discount

RISK

  • All items are shipped at your own risk, and the buyer assumes all responsibility for insuring the delivery. We highly recommend insuring all shipments

DELIVERY DATE

  • Three Pagodas will make every attempt to meet any shipment or delivery date specified, but we will not be responsible or liable for the carrier? failure to ship or deliver by or on any particular date
  • Actual shipping time will vary depending on the shipper? current schedule and the location of your delivery

DAMAGE

  • All shipments are picked up in good condition at Three Pagodas warehouse and Three Pagodas liability ceases at that time. Three Pagodas is not responsible for damage, loss, or other cause alleged to have occurred during or after carrier pick up
  • In the unlikely event that your purchase is damaged or lost during delivery, the customer must fill out a damage or loss claim form directly with the shipper. While Three Pagodas is not responsible for any damage or loss that may occur to your purchase once picked up by the carrier, we will assist you in filing and expediting resolution of such a claim with the shipper
  • Before signing for your delivery, carefully inspect your furnishings, including all packaging, for any damage or loss from shipment. If found, ask the carrier to record all such damage or loss on your invoice and how to file a claim. Immediately file the claim with the carrier and notify Three Pagodas so we can help you expedite the process
  • Keep all original packing material for at least 15 calendar days. In the event you find concealed damage, your shipment must be inspected and returned in the exact package in which it was delivered
  • Depending on the carrier, if concealed damage to your furnishings is found within 3 to 15 calendar days after delivery, a claim of damage will be entertained. Notify the delivering carrier at once and request an immediate inspection. Without an inspection, the shipping company will not consider your claim. Do not move the damaged merchandise from the receiving location as it must be reviewed for inspection. In addition, all packaging material will need to be examined. In the unlikely event that your carrier will not perform the inspection, note the time, date, and person you spoke with and that they failed to comply with your request. This, in conjunction with other papers in your possession will support your claim. Contact Three Pagodas immediately so we can help to resolve your claim
